By accessing or using the MyPoolGuy Business or Pro Portal, you ("Partner") agree to be bound by these Partner Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or continue to use the Portal on behalf of your business.
Partner is responsible for maintaining the confidentiality of its portal credentials and for all activity that occurs under its account, including activity performed by employees or contractors Partner grants access to. Partner agrees to provide accurate business information, including territory, contact, and billing details, and to keep that information current.
Partner's branded chemical products may be surfaced to customers within Partner's configured service territory, subject to Partner's subscription tier and standing (active, not paused, not past-due). MyPoolGuy does not guarantee any minimum volume of customer referrals, leads, or branded impressions.
Partner agrees to pay all fees associated with its subscription tier as described at checkout or in a separately negotiated agreement. Placeholder language only — final billing terms, refund policy, and dispute procedure will be specified in the finalized Terms.
Partner agrees to handle any customer data accessed through the Portal (including names, contact information, and service history) in accordance with applicable law and MyPoolGuy's Privacy Policy, and not to use such data for purposes outside providing pool service to that customer.
Either party may terminate Partner's participation as described in a separately negotiated agreement or, absent one, on notice as specified in the finalized Terms. Placeholder — final notice periods and wind-down obligations are pending legal review.
THE PORTAL IS PROVIDED "AS IS" PLACEHOLDER LANGUAGE. Final disclaimers, warranty language, and liability caps are pending the attorney-reviewed version of these Terms and are not yet in effect.
